This K‑Styler Acceptable Use Policy (the "Use Policy") sets out the rules applied to the use of the Services and System as defined in the Terms of Service agreement (the "Agreement"). It is published by Zenith Labs Limited, a company incorporated in Hong Kong (the "Company", "we", "us"), operator of K‑Styler.
1.1 This Use Policy shall be applicable and interpreted in line with the Agreement. The definitions set out in the Agreement apply to this Use Policy. The latest version of the Agreement is available at the Terms of Service.
1.2 The Company may modify or update this Use Policy at any time. Continued use of the Services/System after changes are published constitutes acceptance of the most updated version. You should periodically review this Use Policy.
1.3 The latest version of this Use Policy is available at Acceptable Use Policy.
1.4 By agreeing to the Agreement, You automatically agree to this Use Policy.
1.5 If You disagree with this Use Policy in any way, You must not use, or must immediately cease using, the Services, System, or any part, feature, or functionality of it.
2.1 The Client agrees to comply with the following general requirements:
2.1.1 You will use the Services/System in compliance with all applicable laws and regulations and in accordance with the Agreement.
2.1.2 You will provide accurate and truthful information when creating an Account and when using the Services/System.
2.1.3 You will use the Services/System in a manner that respects the rights and privacy of others. Harassment, abuse, or harm towards other users or our personnel is strictly prohibited.
2.1.4 You understand that the Services/System are provided for personal styling, informational and entertainment purposes only, and You agree not to use any content, material, or result of the Services as medical, psychological, dietary, or professional advice, remedy, or cure for Yourself or any other person.
2.1.5 You must be at least 18 years old to use the Services/System, and You agree not to provide access to any person under that age.
3.1 The Services require You to upload photographs of Yourself (including body-scan photos and a face/color selfie) so that our technology can generate Your personalized analysis and report. In relation to any image or content You upload, You agree that:
3.1.1 The photographs are of You, and You are the person depicted; You will not upload images of any other person.
3.1.2 You have all rights necessary to upload the content, and doing so does not infringe any third party's rights.
3.1.3 You will not upload nude, sexually explicit, obscene, unlawful, or otherwise objectionable images, or any image of a minor.
3.2 You are solely responsible for the content You upload and for ensuring it complies with this Use Policy and applicable law.
4.1 The following is a non-exhaustive list of prohibited activities and content on or through the Services and System (including our social media accounts, email, and other communications). Prohibited activity is any act or content that is unlawful, or that offends against or is contrary to public interest, public morality, public order, or public and national security.
4.2 While using the System and Services, You agree not to (and will not assist, encourage, or enable others to) — the "Prohibited Activities":
4.2.1 Distribute viruses, malware, spyware, worms, trojan horses, or any code, files, or programs designed to interrupt, hijack, limit, destroy, or negatively affect any software, hardware, network, or telecommunications equipment.
4.2.2 Cause any network resource to become unavailable to its intended users, including via denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks.
4.2.3 Cause damage or service disruption to any third-party computers or services.
4.2.4 Engage in or encourage any unlawful activity, including but not limited to: promoting or facilitating crime (theft, fraud, forgery, bribery, blackmail, money laundering, smuggling, etc.); supporting or promoting terrorism or extremism; deception, fraud, or embezzlement; unlawfully accessing or publishing others' financial, payment, account, or credential data; impersonating any person or entity (including the Company, its personnel, or affiliates) or misrepresenting affiliation; or insulting, slandering, or defaming any person.
4.2.5 Distribute unlawful or illicit content, including pornography or nudity, child sexual abuse material, content promoting vice or human trafficking, or content trading goods/services forbidden by law. Any abuse of minors, hate speech, incitement to violence, extremism, or disinformation on sensitive topics (health, safety, human rights) is a breach of this prohibition.
4.2.6 Engage in or encourage discrimination, racism, or contempt of religion.
4.2.7 Violate any third party's intellectual property rights.
4.2.8 Commit or encourage fraud of any type, including click fraud or generating fake traffic.
4.2.9 Create dishonest social engagement, such as fake profiles, fake reviews, fake likes/shares/comments, or romance or similar scams.
4.2.10 Conduct any invasion of privacy.
4.2.11 Build, enhance, or operate any service or entity that competes with the Services, or assist any party to do so; or reverse engineer, scrape, or use the Services to develop a competing product.
4.2.12 Resell, sublicense, or otherwise commercially exploit any part of the Services or the Company's intellectual property.
4.3 The list in Clause 4.2 is non-exhaustive. You acknowledge that You are solely responsible for how You use the System/Services and bear any resulting liability.
5.1 Clients are expected to exercise reasonable judgment about what constitutes prohibited activity or content.
5.2 In addition to the liability provisions of the Agreement, the Client agrees to defend, indemnify, and hold harmless the Company, its affiliates, and their respective directors, officers, employees, and agents from any third-party claims, demands, and liabilities (including reasonable legal fees) arising from the Client's failure to comply with applicable laws or this Use Policy.
5.3 The Company may suspend or terminate Your access, remove content, and take any legal action it deems necessary to address violations of this Use Policy, in accordance with the Agreement.
6.1 If You become aware of or suspect a breach of this Use Policy by any person, please contact us at hello@mykstyler.com.
6.2 The English-language version of this Use Policy prevails over any translation.
6.3 Any update to this Use Policy takes effect when published on the System.
6.4 The Company will reply to Your inquiries within 30 days (with the possibility of two 30-day extensions where reasonably required).
