This Privacy Policy explains how Zenith Labs Limited, a company incorporated in Hong Kong with registered office at Room C, Flat 6, China Insurance Building, 48 Cameron Road, Tsim Sha Tsui, Hong Kong (the "Company", "we", "us"), collects, uses, discloses, and protects Your personal information when You use K‑Styler (the "System" and "Services", as defined in the Terms of Service). By using the System, You acknowledge this Privacy Policy.
⚠️ Please read Section 4.3 (Scan images and appearance data). To provide the Services, we process photographs of You (body-scan photos and a face/color selfie). We treat these as sensitive and process them only with Your consent and only to provide the Services to You.
1.1 This Privacy Policy is interpreted together with the Terms of Service (the "Agreement"). Defined terms in the Agreement apply here.
1.2 "Personal information" (or "personal data") means information relating to an identified or identifiable individual.
1.3 The Company may update this Privacy Policy at any time; the updated version takes effect when published on the System. Material changes will be signposted where practicable.
2.1 This Privacy Policy applies to personal information processed through the System and Services and in the course of Your relationship with us. It does not apply to third-party websites or services linked from the System.
3.1 The Company is the controller responsible for the personal information processed under this Privacy Policy. Contact details are in Section 12.
4.1 Sources. We collect personal information (i) directly from You (when You complete the pre-purchase quiz, create an Account, upload scan photos, or contact support); (ii) automatically (via cookies and similar technologies when You use the System); and (iii) from our service providers (e.g. our checkout and payment providers).
4.2 Categories. We collect and process:
4.2.1 Identifiers and contact data — name/alias, email address, and Account credentials.
4.2.2 Quiz and profile data — the answers and preferences You provide in the K‑Styler quiz, and body measurements or attributes You submit or that are derived from Your scans.
4.2.3 Commercial and order data — the plan You select, purchase history, and subscription status.
4.2.4 Financial data — processed by our third-party payment providers for payments, subscriptions, and refunds (e.g. transaction IDs, payment method, truncated card details). We do not store full card numbers.
4.2.5 Usage and device data — IP address, device and browser type, operating system, identifiers, timestamps, page interactions, and crash reports.
4.2.6 Advertising and analytics data — statistical and marketing data derived from cookies and similar technologies (e.g. pixels).
4.3 Scan images and appearance data (sensitive).
4.3.1 To generate Your K‑Style report, the Services require You to capture and upload body-scan photographs (front and side) and a face/color selfie. From these images, our technology derives appearance-related attributes such as Your skeletal/body type, color season, and style profile.
4.3.2 We process these images and derived attributes only with Your consent, given when You choose to take the scans, and only to provide the Services to You — namely to generate and display Your report and to power Your personalized app features.
4.3.3 We do not use Your scan images to train artificial-intelligence models, and we do not sell them or use them for advertising.
4.3.4 We do not keep Your scan images. They are processed only to generate Your report and are deleted automatically as soon as Your report has been generated. We retain only the derived, non-photographic results (such as Your body type, color season, and style profile) needed to display Your report and power Your app features. You may withdraw consent at any time (Section 7).
4.3.5 Depending on where You live, appearance or facial-geometry data may be treated as "sensitive," "special category," or "biometric" personal data under applicable law. Where such laws apply, we rely on Your explicit consent and limit our use accordingly.
5.1 We process personal information to:
5.1.1 Provide the Services — create and manage Your Account, run the quiz and scans, generate Your report, and deliver app features (basis: performance of our contract with You).
5.1.2 Process payments and subscriptions — billing, renewals, and refunds through our payment providers (basis: contract; legal obligation).
5.1.3 Process scan images and appearance data — as described in Section 4.3 (basis: Your explicit consent).
5.1.4 Support and communicate with You — respond to inquiries and send service/administrative messages (basis: contract; legitimate interests).
5.1.5 Marketing — send promotional messages where You have opted in; You may opt out at any time (basis: consent).
5.1.6 Improve and secure the System — analytics, product development, fraud prevention, and network security, using aggregated or de-identified data where feasible (basis: legitimate interests).
5.1.7 Comply with law — tax, accounting, and responding to lawful requests (basis: legal obligation).
5.2 Where we rely on consent, You may withdraw it at any time without affecting processing carried out before withdrawal.
6.1 The System uses cookies and similar technologies. Where cookies are not strictly necessary, we ask for Your consent on first visit and provide a means to manage preferences.
6.2 Categories: necessary (login, security, core functionality), preference (settings), statistics/analytics (understanding usage), and marketing (relevant advertising).
6.3 We and our service providers may use analytics and advertising cookies to measure performance and display relevant ads. You can manage or reject non-essential cookies via our cookie tool or Your browser settings. Where supported, we honor Global Privacy Control (GPC) signals as an opt-out of "sharing" for targeted advertising.
7.1 Depending on where You live, You may have some or all of the following rights: to access the personal information we hold about You; to correct inaccurate data; to delete Your data; to withdraw consent; to opt out of marketing and of any "sale" or "sharing" for targeted advertising; to limit use of sensitive information; to data portability; to object to certain processing; and to non-discrimination for exercising Your rights.
7.2 We do not sell Your personal information for money. Our use of advertising/analytics cookies may constitute "sharing" under some laws; You may opt out as described in Section 6.
7.3 How to exercise Your rights. Email hello@mykstyler.com. We may need to verify Your identity. We aim to respond within 30 days (extendable where permitted by law).
7.4 Complaints. You may lodge a complaint with your local data-protection authority — for example, the Office of the Privacy Commissioner for Personal Data, Hong Kong (PCPD); for EEA/UK residents, your national supervisory authority or the UK ICO; for US residents, the FTC or your state Attorney General.
8.1 We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (TLS/SSL), access controls, and restricted internal access.
8.2 We operate internationally and use service providers located in other countries (including the United States and others). Your personal information may be transferred to, stored in, and processed in jurisdictions with different data-protection laws than Your own. Where required, we use appropriate safeguards (such as standard contractual clauses or equivalent) and require recipients to protect Your data to a standard consistent with this Privacy Policy.
8.3 No method of transmission or storage is completely secure; we cannot guarantee absolute security.
9.1 We do not sell personal information. We disclose personal information only as described here.
9.2 Service providers. We disclose personal information to third-party service providers who process it on our behalf, under contract and only for specified business purposes. These include, but are not limited to:
9.3 Legal and safety. We may disclose personal information where required by law or legal process, to respond to lawful requests, to prevent harm or fraud, or to protect our rights.
9.4 Business transfers. In a merger, acquisition, or sale of assets, personal information may be transferred as part of the transaction; we will provide notice where required.
10.1 We keep personal information only as long as necessary to: provide the Services; comply with legal, tax, and accounting obligations; and establish, exercise, or defend legal claims.
10.2 Scan images. Your scan images are not retained. They are deleted automatically as soon as Your report has been generated; we keep only the derived, non-photographic results needed to display Your report and power Your app features.
10.3 Account and transaction records are retained for the duration of Your relationship with us and thereafter as required to meet legal obligations and resolve disputes.
11.1 The Services are intended for users 18 years and older. We do not knowingly collect personal information from anyone under 18. If You believe a minor has provided us personal information, contact us and we will delete it.
